1. Acceptance

By accessing keptcap.com or app.keptcap.com, you agree to these Terms of Use. If you do not agree, do not use the website or demo.

2. Synthetic demonstration environment

The product demo uses synthetic institution, relationship, transaction, pricing, and outcome data. Demo results are illustrative and are not statements about any real institution, customer, account, transaction, or financial outcome.

Do not submit confidential bank information, customer information, account data, authentication credentials, card data, Social Security numbers, or other regulated information to the public demo.

3. Decision-support only

KeptCap is decision-support software. The website and demo do not provide legal, accounting, investment, regulatory, or other professional advice. They do not authorize pricing, move money, approve transactions, contact customers, or replace a bank's governance, ALCO, risk, compliance, or pricing processes.

4. Permitted use

You may use the site and demo to evaluate KeptCap for legitimate business purposes. You may not misuse the service, attempt unauthorized access, interfere with operation, introduce malicious code, scrape the service at unreasonable scale, reverse engineer protected portions except where applicable law permits it, or use KeptCap to violate law or another party's rights.

5. Intellectual property

KeptCap and its associated software, product designs, text, graphics, branding, calculations, workflows, and documentation are protected by applicable intellectual property laws. These Terms do not transfer ownership of KeptCap technology or branding.

6. Third-party services

The site relies on third-party infrastructure and may link to third-party websites or services. KeptCap is not responsible for third-party content or availability, and use of those services may be governed by separate terms.

7. No production commitment through the demo

Features, calculations, workflows, security controls, deployment models, and availability shown in the public demo may evolve. Production or pilot commitments exist only when included in a separate written agreement with the institution.

8. Disclaimers

To the extent permitted by law, the public website and synthetic demo are provided for evaluation on an “as is” and “as available” basis. We do not warrant that the demo will be uninterrupted, error-free, or suitable for a particular institution's regulatory, financial, or operational requirements.

9. Limitation of liability

To the extent permitted by law, KeptCap will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the public website or synthetic demo. Any separate written pilot or commercial agreement may contain different terms that control the services provided under that agreement.

10. Changes

We may update these Terms as the service evolves. Continued use after an update means you accept the revised Terms.
